Please read these terms carefully before using Marc's Inventory.

By accessing and using Marc's Inventory (the "Service"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to abide by the above, please do not use this service. We reserve the right to make changes to these terms at any time and without notice. Your continued use of Marc's Inventory after changes are made will constitute your acceptance of these terms.
To use Marc's Inventory, you must create an account with accurate, complete, and current information. You agree to maintain the confidentiality of your account credentials and are responsible for all activities that occur under your account.
You are solely responsible for maintaining the confidentiality of your password and for all activities that occur under your account. You must notify us immediately of any unauthorized use of your account. We will not be liable for any loss or damage arising from your failure to protect your account credentials.
You represent and warrant that you are at least 18 years of age and have the legal authority to enter into this agreement. If you are using Marc's Inventory on behalf of a business, you represent that you are authorized to bind that business to these terms.
Marc's Inventory operates on a flat-tier subscription model. Plans are Starter ($129/mo), Professional ($299/mo), and Business ($599/mo). Billing occurs monthly on the same day your paid subscription begins, unless you select annual billing for a 17% discount. Add-ons (Additional Location, Custom Domain) bill alongside your plan when enabled.
You authorize us to charge your payment method on file for your subscription fees. Payment is processed through Stripe, our PCI-compliant payment processor. If your payment fails, we will attempt to collect payment up to three times. If payment remains unsuccessful after 30 days, your account may be suspended or terminated.
You agree to notify us of any billing disputes within 60 days of the charge. Billing disputes not reported within this timeframe are considered accepted. You may request a detailed itemized statement of your usage for verification purposes.
Refunds are available within 30 days of purchase if you request cancellation in writing and have not accessed the Service. After 30 days or once you begin using the Service, subscriptions are non-refundable. Upon cancellation, you will retain access to your account through the end of your current billing period.
You agree to use Marc's Inventory only for lawful purposes and in a way that does not infringe upon the rights of others or restrict their use and enjoyment. Prohibited behavior includes:
The Service, including all content, features, and functionality (including but not limited to all information, software, text, displays, images, video and audio), is owned by Marc's Inventory, its licensors, or other providers of such material and is protected by copyright, trademark, and other intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service in accordance with these terms.
You retain all rights to any content you upload or input into Marc's Inventory, including inventory data, print specifications, and business information. You grant Marc's Inventory a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for the purpose of providing the Service.
You may not: (a) reproduce or distribute any content from the Service without permission, (b) modify or create derivative works based on the Service, (c) use the Service's trademarks, logos, or brand assets without permission, or (d) frame or embed the Service in another website without authorization.
The Service is provided "as is" and "as available" without any warranties, express or implied. Marc's Inventory disclaims all warranties, including without limitation, implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Service will be uninterrupted, error-free, or secure.
In no event shall Marc's Inventory be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of data, loss of profits, loss of business opportunity, or loss of use, even if advised of the possibility of such damages. Our total liability to you for all claims arising from or related to these terms shall not exceed the amount you paid to us in the 12 months preceding the claim.
Some jurisdictions do not allow the exclusion of implied warranties or limitation of liability for consequential damages, so some of the above limitations may not apply to you.
You may terminate your account at any time by providing written notice to support@marcsinventory.com. Upon termination, your access to the Service will be revoked, and you will be responsible for any fees owed through the end of your current billing period.
We may terminate your account immediately upon notice if: (a) you violate these terms, (b) you engage in illegal activity, (c) you fail to pay subscription fees for more than 30 days after notification, (d) your conduct is harmful to other users or our business, or (e) we are required to do so by law.
Upon termination, you have 30 days to export your data. After 30 days, we will permanently delete all your data from our servers in accordance with our data retention policies and applicable law.
All data you input or store within Marc's Inventory, including inventory records, customer information, and business metrics, remains your exclusive property. We serve only as a storage and processing provider.
Marc's Inventory encrypts all data in transit and at rest, maintains redundant backups, and undergoes regular security audits. However, no method of transmission over the Internet is 100% secure, and we cannot guarantee absolute security.
If a data breach occurs that compromises your personal information, we will notify you within 72 hours and provide information about the nature and scope of the breach.
Marc's Inventory integrates with third-party services including Stripe, Shippo, QuickBooks, and AWS. These third parties operate under their own terms of service and privacy policies. We are not responsible for the actions, policies, or security practices of these third parties. Your use of these integrations is at your own risk.
Third-party services may change, discontinue, or modify their APIs and services at any time. Marc's Inventory is not liable if third-party integrations become unavailable or change functionality.
We reserve the right to modify these terms at any time. Material changes will be communicated via email or a prominent notice on the website at least 30 days before taking effect. Continued use of the Service after notification constitutes acceptance of modified terms.
Marc's Inventory may modify, suspend, or discontinue any feature or the entire Service at any time with notice to affected users. We will provide at least 90 days' notice before discontinuing the Service entirely, and will provide a pro-rated refund of prepaid fees.
These terms and your use of Marc's Inventory are governed by and construed in accordance with the laws of the State of California, USA, without regard to its conflict of law principles.
Any dispute arising out of or relating to these terms or the Service shall be subject to binding arbitration administered by JAMS under its Streamlined Arbitration Rules. The arbitration shall take place in San Francisco, California, and shall be conducted in English. The arbitrator's decision shall be final and binding and may be entered as a judgment in any court of competent jurisdiction.
Notwithstanding the arbitration requirement, either party may seek injunctive relief in any court of competent jurisdiction to prevent irreparable harm, including breaches of intellectual property rights.
